Short Term Rental Agreement

This Agreement is between the assigned Guest (hereinafter called the Renter) and Casa Caribe Boutique Condo (hereinafter called the Property Manager) concerning the short-term rental of Casa Caribe, Seven Mile Beach, Cayman Islands.

TERMS OF THE AGREEMENT:

  1. CHECK-IN: 3PM  |  CHECK-OUT: 11AM
  2. Office Hours: Mon – Fri 9AM-5PM and Sat 9AM-1PM. If the office is closed at the time of arrival, call the number listed on the office door.
  3. Emergency medical, fire and police services can be called by dialling 911. You may call the office for non-life-threatening emergencies during office hours and the Manager after hours.
  4. Notify the Property Manage immediately of any damage or problems with the property.
  5. If maintenance is required, call the office or the Manager after hours.
  6. Local calls within the Cayman Islands are included at no charge. There is a long-distance block on the telephone – a calling card is needed for long distance toll calls.
  7. Reservations are made by condo numbers, however should some unforeseen matter arise in which we cannot accommodate the booked condo number, the Renter will be placed in an alternative condo within the Rental Pool.
  8. The Renter shall have no more than 6 (six) persons reside or sleep on the premises without prior approval and at a rate of USD75 per each additional person/per day, not exceeding 8 (eight). Some condos do not allow more than 6 (six).
  9. The Renter shall not sublet the property.
  10. Condo access is provided by key at the time of check-in. Renter agrees to return all keys at check-out. If the office is closed there is a drop-box located outside of the office. Key replacement is USD5.00 per key.
  11. Management has the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Should the Renter violate any of the terms of this agreement, the rental period shall be terminated immediately. The Renter waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Renter shall vacate the premises at the expiration time and date of this agreement.
  12. The Renter shall maintain the premises in a good, clean condition, and use the premises only in a careful and lawful manner. The Renter shall leave the premises in well maintained condition at the expiration of the rental agreement, defined by the Property Manager as being habitable for future Renters. Renter shall pay for maintenance and repairs should the premises be left in a lesser condition. The Renter agree that the Property Manager shall charge the Renter’s credit card for damage to the premises or its furnishings.
  13. The Renter shall behave in a civilized manner and shall be good neighbours respecting the rights of the surrounding property owners/guests. The Renter shall not create unreasonable or offensive noise likely to disturb or annoy the surrounding property owners/guests. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and the Renter shall then immediately vacate the premises. Quiet hour starts at 10 PM.
  14. The Property Manager shall provide towels, linens, cups, knives, forks, spoons, dishes, and other items as commonly used by guests.
  15. Housekeeping Service is provided daily with the exception of Sundays and December 25. We insist our Renters utilize this service. This service will help to reduce the amount of wear and tear while maintain a standard of cleanliness. This service is included in your bill and identified as Gratuity Tax.
    Service includes the following:
    1. General cleaning of all rooms
    2. Linen change every third day
    3. Beach Towels replaced daily
    4. Disposal of trash daily
    5. We do not do dishes
  16. Condos are stocked with the following consumable amenities: Shampoo | Conditioner | Bath Soap | Face Soap | Lotion | Facial Tissue | Paper Towel | Dishwashing Pods | Dish Liquid
  17. Cable TV is provided and service level has been chosen by the Property Manager. No refund of rents shall be given for outages, content, lack of content or personal preferences with regard to cable TV service.
  18. High speed wireless internet is provided as a convenience only and is not integral to the agreement. No refund of rent shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.
  19. Renter is advised that the property contains an electric stove and cook top, microwave, and other electric powered items and will seek help from management if the proper operation of such items is not fully understood.
  20. Renter agrees that Air Conditioning shall not be set below 71 degrees, and that the fan setting shall be “Auto”. Doors and windows shall be closed when the air conditioning is in operation.
  21. The property has a fire extinguisher installed in the kitchen/dining room area. The fire extinguisher is fully charged and inspected annually. Renter agrees to use the fire extinguisher only for true emergencies.
  22. The property has smoke detectors installed throughout the condo. The smoke detectors are tested annually and batteries are changed every 6 (six) months. Should a smoke detector be triggered with no cause, report it to the Property Manager.
  23. The property has fire alarms installed which are tested annually. Renter will notify management without delay if a fire alarm is triggered.
  24. No animals or pets of any kind will be brought onto the premises.
  25. There shall be no smoking inside the premises, including the condo patios. Smoking is permitted outside the condo and preferable away from others.
  26. Reservations, cancellations or changes are accepted if received prior to the cancellation periods:
    1. Jan 4 – Dec 14: minimum 60 days’ notice
    2. Dec 15 – Jan 3: minimum 120 days’ notice
    If the reservation is cancelled outside of the applicable cancellation periods, the Renter will forfeit the full amount.
    If the reservation is cancelled within the applicable cancellation period, the Renter will be charged 4% of the rental amount collected.
    Reservations made with advance deposits that need to be moved from original dates booked must be used within a year after change or funds paid will be forfeited.
  27. As soon as a hurricane is anticipated to impact Grand Cayman, the Renter may cancel their vacation and receive a free replacement stay within a similar period for unused nights within one calendar year.
  28. The Renter agree to pay all reasonable costs, attorney’s fees and expenses that shall be made or incurred by the Property Manager enforcing this agreement.
  29. We occasionally experience outages that are beyond our control. We report outages as each occurs. No refunds or compensation will be given for any outages.
  30. There shall be no refunds of rents due to shortened stays or late arrivals.
  31. Renter agrees not to access any locked closets located throughout the condo and/or property.
  32. Renter expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and the Renter does not intend to make the property a residence or household.
  33. Valuable items left behind by Renter will be held for the Renter and every reasonable effort will be made to contact the Renter and make arrangement at the expense of the Renter to mail or further hold said items. If item(s) are not claimed for longer than 6 months, they shall become the property of Casa Caribe. The Property Manager shall not be held liable for condition of items.
  34. Renter shall see to their own security while in the property by locking doors, windows, etc. when it’s prudent to do so.
  35. Renter and Renters Guests’ shall hereby indemnify and hold harmless the Property Manager and the Strata against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. The Renter expressly recognize that any insurance for property damage or loss which the Property Manager may maintain on the property does not cover the personal property of the Renter/Guests. Each condo is equipped with a safe of which we encourage you to lock your valuables away. Safe details are provided at check-in.
